Tidal Investments LLC has officially launched the Free Markets ETF (FMKT), the first exchange-traded fund designed to provide targeted exposure to companies that stand to benefit from deregulatory trends. Debuting on June 9, 2025, FMKT brings a unique thematic approach to market by identifying U.S.-listed equities that exhibit strong upside potential amid shifting regulatory environments.

The actively managed fund is sub-advised by Tactical Rotation Management, SYKON Asset Management, and Point Bridge Capital, combining regulatory intelligence, financial fundamentals, and sector-specific expertise. It joins a small but growing set of ETFs aiming to capitalize on evolving public policy trends.

"FMKT provides investors with targeted exposure to companies we believe are well-positioned to benefit as regulatory burdens are reduced, potentially unleashing significant value across multiple sectors," said Michael Gayed, Portfolio Manager at Tactical Rotation Management.

How This ETF Works

At the heart of FMKT is a proprietary three-step process powered by artificial intelligence and fundamental research. The ETF’s Regulatory Relief Quotient (R2Q) system scans public company filings, earnings transcripts, and regulatory databases to uncover firms most actively positioned for regulatory easing.

  • Target: FMKT screens sectors with historically high regulatory costs—including financial services, healthcare, energy, technology, and transportation.
  • Score: Companies are then ranked using a multi-metric scoring system based on profitability, efficiency, adaptability, and their proximity to regulatory catalysts.
  • Build: A high-conviction portfolio of approximately 30–50 holdings is constructed, spanning all market capitalizations. The portfolio may also allocate up to 5% in Bitcoin or Ether-linked ETPs, though it will not directly hold digital assets.

The ETF carries an expense ratio of 0.76% and distributes income annually.

Why Investors Should Consider FMKT

Regulation costs U.S. businesses an estimated $2.1 trillion annually, with major sectors like manufacturing spending over $50,000 per employee on compliance. FMKT is uniquely positioned to capture the upside from any rollback in these burdens.

  1. A First-of-Its-Kind Strategy: There is currently no other ETF that offers dedicated exposure to deregulation beneficiaries, making FMKT a novel satellite holding in thematic portfolios.
  2. Diversification and Thematic Alpha: As companies adjust to leaner regulatory regimes, FMKT aims to capture margin expansion, faster innovation, and market share growth.
  3. Institutional Framework with Retail Access: The fund opens up institutional-style regulatory intelligence and sector expertise to retail investors via an accessible ETF wrapper.

"By focusing on companies with high regulatory cost sensitivity across sectors like healthcare, financial services, and energy, we aim to identify opportunities where margin expansion and operational improvements can drive outperformance," noted Hal Lambert, Portfolio Manager at Point Bridge Capital.

"Our three-step investment process—target, score, build—allows us to construct a high-conviction portfolio of companies best positioned to benefit from regulatory relief," added Todd Stankiewicz of SYKON Asset Management.
