The cannabis sector, a previously stellar performer in the ETF market, witnessed a surprising decline over the past week. This setback follows weeks of double-digit performance, largely driven by the US Department of Health and Human Service's recommendation to the Drug Enforcement Administration (DEA) for a reclassification of marijuana - an advisory that would revolutionize the entire industry. 

Several combined elements appear to have brought about the week's descent. Key among these is increased short-selling pressure in the market, with short sellers having invested $91 million in new positions wagering against cannabis-related stocks. This speculative activity is serving to drive prices down despite recent robust increases.

Adding fuel to this financial fire is hesitation on Capitol Hill. Regulatory ambiguity surrounding marijuana reclassification has been another critical element precipitating this correction. Legalization would be game-changing for cannabis stocks, helping enormously to boost acceptance across various states. However, political indecision and roadblocks continue to keep investor enthusiasm in check.

Additionally, mounting anxiety around the Secure and Fair Enforcement (SAFE) Banking Act raises concerns over potential legislative delays leading to ensuing weakness in stock prices. Currently making its way through Congress, The SAFE Act seeks to protect financial institutions catering to cannabis-related businesses in states where it is legalized, from federal interferences.

There are still hopes that these setbacks will be temporary, with many closely watching for changes in the Senate’s legislation stance towards decriminalizing marijuana at a federal level.

For now though, last week's market adjustments could be viewed as growing pains - part of the ongoing maturity process triggered by emerging legislation and increased investor scrutiny. With an intriguing legal landscape, substantial interest from lobbyists, and aggressive short selling activities all contributing to dynamics within the sector — ETFs holding cannabis-based assets certainly promise an interesting ride.
